Return of Service Agreements
Often employees would like to undertake additional training relevant to their role. They might have a course in mind, a diploma or a degree.
Some Employees identify courses interstate or overseas and value the course as being an advancement opportunity in terms of their skill and capacity.
For small and medium enterprise owners who must be cautious about lost revenue, the prospect of paying for training for a staff member only to have that staff member leave the company shortly after is very unattractive. It's disappointing and inhibits the Employer from contributing to training opportunities for other employees.
A way to resolve this issue is a 'Return of Service' Agreement (RSA).
A properly drafted RSA can assist both parties to know their obligations in relation to the ongoing development of an Employee.
Return of Service Agreements are beneficial to both the Employer and the Employee.
Employee's are able to undertake the training with financial support from the Employer, and the Employer benefits from the development of the employee's skills and capacity at the workplace with the piece of mind that should the Employee leave, the cost will be recovered.
Return of Service agreements should be drafted in accordance with the obligations of the Employer under workplace relations laws and are best supported by an enforceable industrial instrument .
